my understanding (and this is from a hospital setting) is that any Dr can state that a client hasn't got capacity based on both the mini mental and mental capacity act test. This then has to be secounded by a social care proffessional (mostly social workers, but CCO's do do it) by carrying out an MCA 2 stage test of there own. This is put in place to assure that every attempt has been made to assess a clients capacity levels. However i will admit that this answer is not clear cut and the arrangement has been the result of agreements between my managers and the PCT. |
